1. About these terms
These terms and conditions ("Terms") apply to your use of the website katyahair.com.au (the "Website") and to any services or products you book or purchase through it, including salon appointments, the KATYA online course, in-person workshops and training, and Colour Board orders.
By using the Website, booking an appointment, enrolling in a course or workshop, or placing an order, you agree to these Terms. If you do not agree, please do not use the Website or our services.
In these Terms, "KATYA", "we", "us" and "our" means KATYA Hair and Beauty Pty Ltd. "You" and "your" means the person using the Website or purchasing from us.
Nothing in these Terms limits or excludes any rights you have under the Australian Consumer Law or any other law that cannot be limited or excluded (see section 8).
2. Using the Website
The Website is provided for your personal use and for professional hairdressers interested in our education and products.
We take care to keep the Website accurate and up to date, but we do not guarantee that all content is complete, current or error-free. Prices, availability and service details may change without notice. Changes do not affect bookings or orders already confirmed.
You must not use the Website for any unlawful purpose, attempt to gain unauthorised access to any part of it, or interfere with its operation.
The Website contains links to third-party services, including our booking platform (Timely), Instagram, video hosting and payment providers. We are not responsible for the content, availability or privacy practices of third-party sites and services. Their own terms apply to your use of them.
3. Salon appointments
3.1 Booking
Appointments are booked through our online booking system (Timely) or by contacting us directly. A booking is confirmed once you receive a confirmation from the booking system or from us.
3.2 Cancellations, deposits and late arrivals
Our cancellation policy, deposit requirements and late arrival policy are set out in our Appointment Guide. These form part of these Terms. Please read the Appointment Guide before booking. Any cancellation fee we charge is a reasonable estimate of the cost to us of a late cancellation or missed appointment.
3.3 Pricing
Service prices shown on the Website are in Australian dollars, include GST, and are indicative "from" prices based on hair length and the service package. Your final price depends on your hair, the products used and the time required, and will be confirmed with you at consultation before we begin. Some services, including camouflage correction, are available by consultation only.
3.4 Consultation and your responsibilities
Colour services depend on the condition and history of your hair. To help us deliver a safe and predictable result, you must tell us about any previous chemical treatments (including box dye, henna, keratin or straightening treatments), scalp conditions, allergies, medications or pregnancy before your service. We may decline or modify a service if we believe it is unsafe or unlikely to achieve a good result. We may also require an allergy or strand test before certain services. Clients under 18 require the consent of a parent or guardian for chemical services.
3.5 Results
We will always give you our honest professional advice, but hair is not an exact science. Colour results, longevity and grow-out vary with hair condition, history and home care. If a result is not as agreed at consultation, please contact us as soon as possible on 0488 067 783 (ideally within 7 days) so we can assess and, where appropriate, adjust the work. Change-of-mind adjustments after an agreed result may be charged as a new service. This does not limit your rights under the Australian Consumer Law.
3.6 Photography
Work may be photographed or filmed for the KATYA portfolio and social media. Let us know at your appointment if you would prefer not to be photographed and we will respect that.
4. Online course
4.1 What you are buying
When you purchase the KATYA online course, you receive a personal, non-transferable licence to access and view the course content for your own professional learning. Course access is delivered through the Website with video hosted on a third-party platform.
4.2 Access and account
You must not share your login, download, copy, record, screen-capture, distribute or resell any part of the course, or use the content to create your own training material. Doing so is a breach of these Terms and may infringe our intellectual property rights. If we reasonably believe you have breached this clause, we may suspend or terminate your access after giving you notice and an opportunity to respond.
We aim to provide access for the life of the course. If we retire or substantially change the course, we will give you at least 30 days' notice to complete it.
4.3 Refunds
Because the course is digital content available immediately after purchase, we do not offer refunds for change of mind once access has been granted. Please review the course outline and any preview content before purchasing.
This does not affect your rights under the Australian Consumer Law. You are entitled to a remedy if the course is faulty, is not as described, or cannot be accessed for reasons within our control and we cannot fix the problem within a reasonable time. Contact us at katerynamail@gmail.com if you have a technical issue and we will help.
4.4 No guarantee of outcomes
The course teaches technique. Your results will depend on your own skill, practice and the hair you work on. We do not guarantee any particular professional or commercial outcome.
4.5 Technical requirements
You are responsible for having a device and internet connection capable of streaming video. We are not liable for interruptions caused by your equipment, your internet provider or third-party hosting platforms outside our control, except where the law provides otherwise.
5. In-person workshops and training
5.1 Booking and payment
Workshop places are confirmed on receipt of full payment (or a deposit where stated). Workshop prices are shown in Australian dollars. Where a price is shown exclusive of GST, the total price including GST will be shown before you pay. In-salon team training is arranged by enquiry and quoted individually.
5.2 Cancellation by you
More than 14 days before the workshop: full refund less any non-refundable deposit, or transfer to a later date.
14 days or less before the workshop: no refund, but your place may be transferred to another stylist you nominate, or credited to a future workshop at our discretion.
Non-attendance on the day is treated as a late cancellation.
Non-refundable deposits and late cancellation charges reflect our reasonable costs of holding your place, venue and materials. This clause does not limit your rights under the Australian Consumer Law.
5.3 Cancellation or changes by us
We may reschedule or cancel a workshop if minimum numbers are not reached or for reasons outside our control (including illness, venue issues or travel disruption). We will give you as much notice as possible, and at least 7 days' notice where a workshop is cancelled for low numbers. If we cancel, you may choose a full refund or a transfer to another date.
We recommend booking flexible or refundable travel and accommodation. Except where the law requires otherwise, we are not responsible for travel or accommodation costs you incur.
5.4 Conduct and materials
Workshop content is for your own professional development. You must not record sessions or reproduce workshop materials without our written permission. We may ask anyone behaving in an unsafe or disruptive way to leave, and no refund will be given in that case.
5.5 Photography
Workshops may be photographed or filmed for KATYA's education and marketing. Let us know before the session if you do not wish to appear.
6. Colour Board and product orders
6.1 Orders
An order is accepted when we send you an order confirmation. We may decline or cancel an order (with a full refund) if a product is unavailable, if there is a genuine pricing or listing error, or if we suspect fraud. We will tell you promptly if this happens.
6.2 Pricing
Product prices are in Australian dollars and include GST for orders shipped within Australia. Shipping costs are shown at checkout before you pay. Orders to New Zealand may attract local import duties or taxes, which are your responsibility.
6.3 Shipping
We ship to Australia and New Zealand. Orders are dispatched within 3 business days. Delivery times shown are estimates and depend on the carrier. Once dispatched, we will provide tracking where available.
International shipping outside Australia and New Zealand can be arranged directly with us at an additional cost. Please contact us at katerynamail@gmail.com before ordering.
Risk in the goods passes to you on delivery. Please check your delivery address carefully, as we are not responsible for orders sent to an incorrect address you have provided.
6.4 Returns and faulty products
If your Colour Board arrives damaged, faulty or not as described, contact us as soon as possible (ideally within 7 days of delivery) with photos and we will arrange a replacement, repair or refund in line with the Australian Consumer Law. We will cover reasonable return shipping costs for faulty items.
We do not offer refunds or exchanges for change of mind. Please choose carefully.
6.5 Wholesale
Wholesale and stockist enquiries are handled separately and are subject to a separate agreement.
7. Payments
Payments are processed through third-party payment providers via our Website and booking platform. We do not store your full card details. By making a payment you confirm you are authorised to use the payment method. If a payment fails or is reversed, we may suspend the relevant service, access or order until payment is received.
8. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to cancel the service and receive a refund for the unused portion, or compensation for its reduced value. For major failures with goods, you are entitled to a replacement or refund, and compensation for any other reasonably foreseeable loss or damage. If a failure is not major, you are entitled to have the problem fixed within a reasonable time.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where a clause in these Terms would otherwise do so, it applies only to the extent permitted by law.
If you are a consumer in New Zealand, you may also have rights under the New Zealand Consumer Guarantees Act 1993 which these Terms do not exclude.
9. Intellectual property
All content on the Website and in our courses, workshops and materials, including text, images, video, logos, the KATYA name and brand, illustrations, course materials and the Colour Board design, is owned by or licensed to KATYA Hair and Beauty Pty Ltd and is protected by copyright and, where applicable, trade mark and design law.
You may view and print content from the Website for your personal, non-commercial use. You must not otherwise copy, reproduce, adapt, publish, distribute or commercially exploit any content without our prior written permission.
10. Liability
To the extent permitted by law:
We are not liable for any indirect or consequential loss, loss of income, loss of business or loss of opportunity arising from your use of the Website, our services or products.
Our total liability to you in connection with any service, course, workshop or product is limited to the amount you paid for it, or, where the Australian Consumer Law permits, to resupplying the service or product or paying the cost of resupply.
We are not liable for outcomes resulting from inaccurate or incomplete information you provide about your hair history or health, or from your failure to follow aftercare advice.
We are not liable for delays or failures caused by events outside our reasonable control.
Nothing in this section limits our liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded by law.
11. Privacy
We collect and handle your personal information in accordance with our Privacy Policy (below) and the Privacy Act 1988 (Cth). This includes information collected through our booking system, online store and course platform.
12. Changes to these Terms
We may update these Terms from time to time. The current version will always be published on the Website with the date it was last updated. Changes apply only to bookings, enrolments and orders made after the date of the change.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any dispute will be subject to the non-exclusive jurisdiction of the courts of New South Wales. If you are a consumer, nothing in this clause prevents you from making a complaint to NSW Fair Trading or your local consumer protection agency.
